Terms of Service for Hatch Finances

Welcome to Hatch | Finances.

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and Hatch Finances LLC (“we,” “our,” or “us”). These Terms govern your access to and use of the Hatch | Finances cross-platform web and mobile applications, our backend APIs, and any related tools or services (collectively, the “Service”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. Nature of the Service (Not Financial Advice)

1.1 Educational Purposes Only: Hatch | Finances is designed as a visual-first financial command center to help you understand your wealth management. Features such as our FIRE (Financial Independence, Retire Early) calculators, Monte Carlo simulations, tax refund maximizers, Social Security estimators, and “next best move” suggestions are provided for informational and educational purposes only.

1.2 No Fiduciary Relationship: Hatch Finances LLC is strictly a software provider. We are not a fiduciary, registered investment advisor, broker-dealer, financial planner, tax professional, or legal advisor. None of the information provided by the Service constitutes financial, tax, or legal advice. You should consult with a licensed professional before making any financial decisions.

1.3 Accuracy of Projections: Financial computations (such as Monte Carlo simulations and compound interest engines) rely on randomized iterations, mathematical models, historical data, and the accuracy of the data you input. We do not guarantee the accuracy, completeness, or future reliability of these projections. Market conditions fluctuate, and past performance does not guarantee future results.

2. Eligibility and Accounts

2.1 Age Requirement: You must be at least 18 years old to create an account and use the Service. By creating an account, you represent and warrant that you meet this age requirement.

2.2 Account Registration & Security: To use the Service, you must create an account. We utilize third-party enterprise-grade security (Clerk) to manage authentication and Multi-Factor Authentication (MFA). You are entirely responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account.

2.3 Accurate Information: The Service requires accurate input to function properly (including data regarding family members, residences, salaries, assets, liabilities, and mortgages). You agree to provide and maintain true, accurate, and current information. Hatch Finances LLC is not responsible for inaccurate tax, FIRE, or retirement estimates resulting from outdated or incorrect user inputs.

3. Subscriptions and Payments (Pro Tier)

3.1 Free and Pro Tiers: Hatch | Finances offers a “Free” tier and a premium “Pro” tier. The Pro tier provides access to advanced features, including live account linking.

3.2 Billing & Payments: All payments for the Pro tier are processed securely by our third-party payment processor, Stripe. By upgrading to Pro, you authorize Hatch Finances LLC (via Stripe) to charge your selected payment method on a recurring basis (e.g., monthly or annually) according to the terms of your selected plan.

3.3 Cancellations & Standard Refund Policy: You may cancel your Pro subscription at any time through your account settings. Cancellations will take effect at the end of your current paid billing cycle. All subscription fees are non-refundable. We do not provide refunds or credits for partial billing periods, unused time, or accidental subscriptions.

4. Third-Party Integrations & Linked Accounts

Hatch | Finances relies on critical third-party infrastructure to deliver the Service. By using the Service, you also agree to be bound by the relevant terms of these providers:

4.1 Plaid (Account Linking): Users on our Pro tier may link external bank accounts, brokerages, credit cards, and mortgages to automatically sync balances and transactions. This data fetching is facilitated by Plaid Inc.

• By using this feature, you grant Hatch Finances LLC and Plaid the right, power, and authority to act on your behalf to access and transmit your personal and financial information from the relevant financial institution.
• You agree to your personal and financial information being transferred, stored, and processed by Plaid in accordance with the Plaid End User Privacy Policy.

4.2 Other Providers: Your use of the Service is also subject to the operational realities of our hosting, database, and authentication providers (including Render, Neon, and Clerk).

5. User Data, Privacy, and Security

Your privacy is important to us. Our data practices, including how we collect, store, and process your household and financial data, are governed by our Privacy Policy.

While we employ industry-standard database security measures (such as PostgreSQL encryption at rest and secure SSL connections), you acknowledge that no transmission of data over the internet is completely secure. You provide your financial data at your own risk.

6. Acceptable Use

You agree that you will not:

• Reverse-engineer, decompile, or disassemble the Hatch | Finances web application, mobile application, or our backend API.
• Attempt to bypass our authentication, MFA, or rate limits.
• Use the Service to store or transmit malicious code, or to engage in illegal, fraudulent, or money-laundering activities.
• Scrape, spider, or use automated means to access our financial computation engines.

7. Disclaimers and Limitation of Liability

7.1 “AS IS” Basis: THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. HATCH FINANCES LLC EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

7.2 Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HATCH FINANCES LLC, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, NET WORTH, OR DATA INCURRED BY YOU. YOU ASSUME FULL RESPONSIBILITY FOR ANY FINANCIAL DECISIONS, TRADES, OR TAX FILINGS MADE BASED ON THE DATA OR VISUALIZATIONS PROVIDED BY HATCH | FINANCES.

8. Governing Law

These Terms, and any dispute arising out of or related to them, shall be governed by and construed in accordance with the laws of the State of Oregon, USA, without regard to its conflict of law principles.

9. Changes to the Service and Terms

We are constantly updating Hatch | Finances (including over-the-air updates to our mobile app and backend mathematical models). We reserve the right to modify or discontinue any feature, or update these Terms, at any time. If we make material changes to these Terms, we will notify you via email or a prominent notice within the app. Your continued use of the Service after changes to the Terms constitutes your acceptance of the revised Terms.
